All sales are final. We do not offer refunds, exchanges, or credits for any subscription plan or one-time purchase. By completing a purchase, you acknowledge and agree to this no-refund policy. 1. Acceptance of Terms
By accessing or using ValuIQ ("the Service") at https://www.getvaluiq.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users including browsers, registered users, and subscribers.
2. Description of Service
ValuIQ provides an AI-powered resale profit intelligence platform that helps users evaluate items for resale. The Service uses artificial intelligence to estimate resale values, fees, and profit margins. ALL information provided is for educational and informational purposes only. ValuIQ makes NO guarantee of accuracy, and resale values fluctuate constantly based on market conditions.
3. No Financial or Investment Advice
Nothing on ValuIQ constitutes financial, investment, or business advice. Profit estimates are AI-generated approximations based on available data and are NOT guaranteed. Actual results will vary. You are solely responsible for any purchasing decisions you make. ValuIQ is not liable for any financial losses resulting from use of the Service.
4. Subscription Plans and Billing
ValuIQ offers Free, Seller, Pro, and Lifetime subscription tiers. Paid subscriptions are billed in advance on a monthly or annual basis via Stripe. Subscription fees are charged automatically at the start of each billing period. You authorize ValuIQ to charge your payment method on file. Prices are subject to change with 30 days notice.
5. No Refund Policy
ALL SALES ARE FINAL. ValuIQ does not offer refunds, credits, or exchanges for any reason including but not limited to: unused scan credits, dissatisfaction with AI results, change of mind, accidental purchase, or inability to use the Service due to technical issues on your device. Lifetime plan purchases are non-refundable one-time payments. Monthly and annual subscriptions are non-refundable once a billing period has started. If you believe you were charged in error, contact support@getvaluiq.com within 7 days.
6. Cancellation
You may cancel your subscription at any time through your account settings or by contacting support@getvaluiq.com. Cancellation stops future billing but does NOT entitle you to a refund for the current billing period. You retain access to paid features until the end of the current billing period. Lifetime plans are not subject to cancellation as they are one-time purchases.
7. Free Trial and Free Tier
The free tier includes 5 scans per calendar month. Free tier usage resets on the first day of each month. ValuIQ reserves the right to modify or discontinue the free tier at any time. Free tier users are subject to all Terms of Service including the No Refund Policy if they upgrade to a paid plan.
8. Acceptable Use
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to reverse engineer, scrape, or copy the Service; (c) use automated tools or bots to access the Service beyond normal use; (d) resell or redistribute access to the Service without written permission; (e) use the Service to harass, defraud, or harm others; (f) circumvent any scan limits or access restrictions.
9. Intellectual Property
All content, features, and functionality of the Service including the software, AI models, design, text, and graphics are the exclusive property of ValuIQ and are protected by copyright and intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service.
10. Accuracy of AI Results
ValuIQ uses AI to estimate resale values. These estimates are based on historical sales data and market trends, and are NOT real-time prices. Actual resale values depend on item condition, platform demand, timing, and many other factors outside our control. ValuIQ makes no warranty that AI results are accurate, complete, or suitable for your specific situation. Never make a purchase solely based on our AI output without independent verification.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. VALUIQ EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VALUIQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 3 MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless ValuIQ, its officers, directors, employees, and agents from any claims, damages, losses, and expenses including reasonable attorneys' fees arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any purchasing decisions you made based on information from the Service.
14. Privacy
Your use of the Service is also governed by our Privacy Policy. We collect information you provide when creating an account and data about your use of the Service to improve our AI models and user experience. We do not sell your personal information to third parties. Scan data may be used in aggregate to improve the Service.
15. Changes to Terms
ValuIQ reserves the right to modify these Terms at any time. Changes will be effective upon posting to the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms. We will make reasonable efforts to notify users of material changes.
16. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Service shall be resolved in the courts of Florida.
